How Is Divorce Different Among the Elderly?

While many people think of divorce happening to younger couples, or perhaps to those who have been married for 15-20 years, the fact is divorce really knows no age limits. Even some couples that have been married for decades end up getting divorced. In addition, some couples that marry later in life also decide that being married is not for them. Whatever the reason people in all stages of marriage do end up getting divorced. However, divorce can be different for every couple, and how your divorce plays out can have a lot to do with what stage of life you find yourself in.

Divorce for a couple that has only been married for a few years will often be much different than for a couple that has been married for 30 years or more. Likewise, couples that are in their 20s will most likely deal with a much different divorce process than those who are in the latter stages of their lives. In addition, anyone who has been in a long-term marriage or who is divorcing after the age of 60, will face a unique set of circumstances that are usually much different than what those who divorce at younger age will face.

Some of the common issues that arise for elderly couples who divorce include how to handle disability benefits, Social Security, inheritance, health care, spousal support and estate planning. It’s not that these issues can’t be a factor in any divorce, but they are much more likely to be a part of a divorce involving the elderly. Because these factors are so important in the latter stages of life, it’s very important to have the proper representation when you choose to get divorced later in life.
