On June 26, 2015, the United States Supreme Court ruled in the case of Obergefell vs. Hodges that every state must now allow marriages between two people of the same-sex. Additionally, the Supreme Court went on to say that every state must also recognize a lawfully performed marriage whether the couple is of the same-sex or opposite sex.
The Supreme Court made it very clear that the Fourteenth Amendment provides that no state shall “deprive any person of life, liberty, or property, without due process of law”. This includes the fundamental right to marry in all states.
The Supreme Court has now brought uniformity to the treatment of same-sex couples for federal, as well as state purposes, for such legal issues as spousal benefits, retirement recognition, social security, adoption, tax filing status, and healthcare coverage.
The Supreme Court also opened the door to allow same-sex couples to seek relief from state courts to divorce, make decisions regarding their children, support, property division and all other critical issues that are addressed in domestic relations cases. Michigan, like every other state in the country, will now recognize “same-sex marriages” and “same-sex divorces”.
